JUST IN: Tinubu’s Election Can’t Be Nullified Because Of iREV – Supreme Court

Supreme Court has upheld that the election of President Tinubu cannot be nullified because of the Independent National Electoral Commission, INEC’s failure to transmit electronic results electronically.

Gatekeepers News reports that the Supreme Court in the judgement delivered by Justice Iyang Okoro agreed with the lower court that iREV is not a collation centre and that there is an elaborate arrangement to ensure that copies of results are available.

Justice Okoro said, “The unavailability of the iREV cannot be a ground for the nullification of the election.

“The failure to transmit results to irev did not affect the results of the election.”

In the September 6 judgment, the tribunal held that INEC has the right to issue guidelines and manuals in line with the provisions of the Electoral Act.

It added that INEC was at liberty to determine the procedure of how its election will be conducted.

The presidential candidates of the Peoples Democratic Party (PDP) and Labour Party (LP), Atiku Abubakar and Peter Obi had asked for nullification of the election over non-compliance with the rules which INEC set out in its guidelines, which includes e-transmission of results.
