A Federal High Court in Lagos has adjourned proceedings in the case involving businessman and social media influencer Afolabi Kazeem Michael, popularly known as KC Luxury, until September 21, 2026.
Gatekeepers News reports that Justice Friday Ogazi fixed the date after lawyers for KC Luxury and the National Drug Law Enforcement Agency (NDLEA) agreed that the court should await the ruling of another Federal High Court on an application challenging its jurisdiction to entertain the matter.
KC Luxury’s counsel, Abdulakeem Labi-Lawal, SAN, challenged the 30-day detention order secured by the NDLEA, arguing that the order did not expressly require his client to remain in custody for the entire period.
The defence is also contending that the Administration of Criminal Justice Act (ACJA) 2015 does not permit a single 30-day pre-charge remand order. The lawyers specifically cited Section 296(1), which they said limits an initial remand order to 14 days and requires further judicial review where investigators need additional time.
KC Luxury was arrested by NDLEA operatives on August 13 at the Murtala Muhammed International Airport, Lagos, while preparing to travel to Paris. The agency linked him to the seizure of 184.5kg of cocaine, which it described as its largest cocaine seizure from a courier company.
The NDLEA subsequently obtained an order on August 20 authorising his detention for 30 days to enable further investigation. The agency has alleged that he was the “Nigerian arrowhead” of an international drug cartel, allegations which remain subject to legal proceedings.
His lawyers are asking the court to set aside the detention order, arguing that no criminal charge has been filed against him and that continued detention could violate his constitutional right to personal liberty. They have also challenged the court’s jurisdiction to issue the pre-charge detention order.
NDLEA did not oppose the latest adjournment. Its counsel, Abu Ibrahim, however, clarified that the 30-day remand order was obtained in August before KC Luxury subsequently approached the court seeking an order for his production. Justice Ogazi consequently adjourned the matter to September 21 for further proceedings.
