Federal High Court Chief Judge Denies Nnamdi Kanu’s Recusal Request On Justice Nyako

Chief Judge of Federal High Court of Nigeria, Justice John Tsoho has rejected the detained leader of proscribed Indigenous People of Biafra (IPOB), Nnamdi Kanu’s request for Justice Binta Nyako to recuse herself from his case.

Gatekeepers News reports that the chief judge returned Nnamdi Kanu’s case file to Justice Binta to handle. He noted that two other judges were previously recused from the case.

Justice Tsoho said the decision was made because Kanu’s case was reassigned to Justice Nyako because of its prolonged nature dated back to 2015.

He added that since Justice Binta had handled the case for the most part, she was deemed the most suitable judge to see it through to its conclusion.

The Chief Judge however directed that if at the next hearing of the case, Kanu still insists on recusing Justice Nyako, he must file a written motion on Notice, with an affidavit, stating his reason for requesting the recusal.

The IPOB leader must also present it to the prosecution team, and appear before Justice Nyako for her review and determination, after which she can make her decision.
